Please read the following information carefully. If you do not agree to these conditions, you must not participate in this activity. Individuals under age 18 must have this form signed by parents or legal guardian.

Date of Activity:  February 2, 2008.  Location:  Lambert Park, Alpine UT

Nature of Activity.  I understand that this activity is a winter-time cross-country mountain bike race, and that I should expect difficult and hazardous riding conditions.

Understanding of Risks.  Mountain biking is an inherently dangerous sport, and can result in death or permanent injury. The activity specified above will occur under circumstances that make the riding surface hazardous and will increase these risks substantially. Compared to usual riding conditions, the rider must expect significantly higher likelihood of injury and increased severity of injury. Dangerous conditions on the riding surface will include (but are not limited to) frozen rough ground, ice, snow, water, mud, rocks, and steep slopes. Those individuals who have volunteered to assist the participant in this activity will take no action to mitigate these natural risks, and offer no guarantee of safety. Loss of control of the bike can result in serious injury or death to the rider.

Terms of Participation.  I agree to operate my bike in a safe manner at all times. I will wear a bike helmet while participating in the activity. I assume responsibility for the mechanical performance of my bicycle. I undertake the activity of my own free will, and am responsible for my own safety.

Temporary Right of Entry to Private Property.  I understand that portions of the race route might cross privately-owned property. I agree to hold harmless the owners and agents of each and any such property. I agree that permission to enter the private property is granted only for the duration of the race, and does not constitute future right of entry or right of passage.

Release from Liability.  I release Mad Scientist Software, UtahMountainBiking.com, Utah Rocky Mountain Bikers, Alpine City, and the owners of each and any private property on the course of this race and their respective agents from liability for any and all injury arising from my participation in this activity.

Waiver of Right to Recover Damages.  On behalf of myself and my heirs, I waive any and all rights to recover damages for injury or death arising from this activity. Should injury or death occur, neither I nor my heirs will file a claim against any individual, corporation, municipality, or other organization associated with this activity, regardless of any finding of fault or allegation of negligence on their part.

Agreement to Pay for Defense.  Should I or my heirs make a claim against Utah Rocky Mountain Bikers, Mad Scientist Software, agents or employees of Mad Scientist Software, UtahMountainBiking.com, or individuals assisting voluntarily with this activity, I and my heirs will be liable for payment of their associated expenses, including legal fees, court costs, expert witness fees, and lost wages.

I have read and understand the above conditions, and agree to be bound by them.  (If participant is under age 18, the signature of parent or guardian below indicates their agreement to the above conditions.)
